It appears that CMS at the top have decided that they are helpless when you patients are "dumped".<
>This group of physicians Dr. Myrick signed as did Mr. Tom Simmons of Collom & Carney that they were dismissing her just because they can. She has done nothing wrong and her rights were violated as well as her freedom of speech. You think that the government will protect you? They have known for 5 years the horrors that you have lived with and have done nothing to side with you. A physician can dump you because they can, you have no rights. You have the industry ESRD Network that went in and talked to the patients and of course found nothing...I have been contacted by many of the same patients and they feel different. They have come to us and we will be furnishing this patient with an attorney as all there rights have been violated, with CMS backing the decision of the NETWORK ,and CMS has not talked to any of the patients and the NETWORK did nothing to protect her. They had all the
ave patients go into a room to talk and then they are told that the ESRD cant protect them.The government let you down.<

I for one will not allow this to happen. The ESRD Network sold you down the river. It will go to court. You have no rights.<

Are arrangements being made to dialysis the patient at some other location before the patient ends up in the hospital?<

The arrangements are being made for the patient. Another clinic has been contacted.<

We will be meeting with two law firms, as we really felt CMS would naturally help this patient, instead they trusted the industry who told them a different story than other patients that dialize in that same clinic told us. They dialize there and should be able to know if they have issues.So one must realize that this industry is corrupt all the way to the top.<

Do I understand this correctly? That CMS has chosen not to do anything to protect the patients at risk from being dumped by their physicians or the clinics that they dialyze at? <

>If this is so, than I am extremely disturbed and disappointed to hear that CMS is unable / unwilling to stop this practice that they have known about for at least 5 years now. I find it incomprehensible that a government who guarantees payments for life saving dialysis treatments for it's citizens, refuses to intercede on their behalf when their physician and or clinic decides to dump that patient due to any whim of their choosing. It seems to me that it is a clear violation of a patient's civil and human rights that a physician or clinic can dump a patient just because they may not like that patient's skin or hair color, their questions, thirst for knowledge about their disease and it's treatment, or anything other than actual violence!<

I am sickened and upset that we must check our dignity and human rights at the door when we are at dialysis. These people accept funds from the government for our care only to be thrown out in the street like yesterdays trash. Clinic, Neph. and Network needs to be held accountable for any injury that may occur to this patient.:">

We have contacted one of the law firms that have sucessfully handled one of our cases in Texas. We are on firm ground and the poster child will be the Texarkana Clinic.These are high power seasoned attorneys, it looks as if they are going to take this on,<

It appears that two more patients have been discharged and have no where to dialize. Government is not helping them either.<
>Will find out more information, but this is getting wider spread and I was told that in Jan of this year that the clinics could no longer be able to do it. Information of course by the Network.

Each and everyone of the patients in this clinic is at risk. Those who attended the meeting were observed by management and the patients attended the meeting in the understanding that it was safe to speak out to the network rep who was there. That rep in turn showed his true colors and the side he is on by turning around and letting the patients know that the network and CMS would not honour patients civil or human rights, that they could be dismissed for any reason the clinic or Dr's wished to use and that the network would allow it to happen. <

>These patients ALL now live in fear of being dismissed and retaliated against. They need our encouragement, support and help in standing firm! :">

I have been on the phone all morning. We are not going to talk and dialogue only anymore. We are getting together with many churches in the South....and are orchestrating a demonstration that will be happening on the same day in different parts of the country. The churches are outraged and feel that this is a clear cut violation of Civil, Human and patient rights.<

I have personally tried as others to work with the government..they clearly have done nothing, cause they have not been forced too. I am tired of dialogue and will be joining the marches. We are disappointed that it has come to this, but we now have 3 black African American patients dismissed, and a government that has just shrugged their heads. They are accountable.<

When will the protests/marches/demonstrations take place? I know Arlene and others behind the scenes have been working on many things. In my opinion, we need to go ahead with some of these. <
