>Will you please verfiy some infomation, and include in your investigation should you deem such appropriate.<

>It has come to our attention that primary staff of CMS and or others in decision making capacities, including member(s),may have been employed by and or received money from the dialyis industry including Amgen. For instance, Thomas Scully, prior to his current appointment, was a member of the Board of Directors for DaVita (Total Renal Care).Brady Augustine, prior to being in CMS was employed by Gam
o which as we know is another Dialysis company. Nancy DePearl was in Mr. Thomas Scully's position and is now on the board of directors of DaVita. She has been in receipt of correspondence in the 2000 hearing on dialysis. Have your investigations included any information which verfiies the information we have been given.<

>We are concerned about "possible collusion" between government employees, who supposedly make decisions to benefit the patient, and the dialysis industry, who could possibly gain financially . If collusion does exist. it stands to reason that the patient will continue to be at risk and fearful of complaining about substandard treatment and lack of quality care. <
> <
>Our meeting with CMS on August 11, 2003 made it quite clear that it would take an act of Congress to change the current areas of responsibility mandated to the ESRD Network. The patients will continue to fear with all of the above "perceived" collusion. We take a strong postion that before patients will continue to be fearful or be comfortable to express grievances or complaints with this current set up of CMS,ESRD NETWORKS, AND THE DIALYSIS INDUSTRY. The patients dismissals are one area that needs to be investigated.<

>Be reminded that we are awaiting final word on the date/time for the Senate Finance Committee Hearings. If for some reason the hearing will not be held, then we still are asking for a meeting as our tickets have already been purchased. We will be in Washington DC on October 16 and 17th.<

>Thank you<

"Like me, you could.....be unfortunate enough to stumble upon a silent war. The trouble is that once you see it, you can't unsee it. And once you've seen it, keeping quiet, saying nothing, becomes as political an act as speaking out. Either way, you're accountable."
